THE DIFFERENCE BETWEEN PHYSICAL AND LEGAL CUSTODY

As a parent in New Jersey, you can have physical or legal custody of your child.

Physical custody means in which home or with which parent the child lives, primarily. (PPR).

Legal custody means which parent makes decisions about the child’s education, healthcare, religion or other major issues that affect the child’s welfare. This can be one or both parents.

We can help you create a plan that meets your child’s needs. In most cases, there will be joint legal and physical custody, with both parents having similar parenting time. Parenting time is most often “shared.” This means it is very rarely an exact 50-50 split. Typically, due to a child’s school and extracurricular activity, the arrangement will be closer to a 60-40 or even a 70-30 split of time. Parents going into negotiations who understand this typically fare better and have less contention.

JOINT CUSTODY IS TYPICAL BUT NOT ALWAYS GRANTED

When you and the other parent have joint legal custody, you will both have equal legal authority when making decisions that affect the child. In rare cases, one parent is given sole legal and physical custody. This is usually in cases that have a proven history of abuse, neglect, addiction, mental health issues or incarceration of one parent. Your custody arrangement will affect the amount of child support that is paid.
