At the Law Offices Of Michael P. McGuire LLC, we know what a major life change a divorce is. We offer compassionate counsel and assertive representation to pursue the results you are looking for.

PROVIDING KNOWLEDGEABLE ASSISTANCE THROUGHOUT AN UNSTEADY TIME

So many things are uncertain during a divorce or family law matter. At the Law Offices Of Michael P. McGuire LLC, we understand that you want information and that you need to have personal access to your attorney. We offer personal, accessible service that is focused on your goals. We assist with a broad spectrum of matrimonial law issues, including:

DIVORCE AND PROPERTY DIVISION

Our extensive financial education and experience mean that you will get an accurate evaluation of the assets and therefore an equitable division of your property. We are well versed in financial and life planning instruments, all of which will need to be updated during your divorce.

We offer shrewd insight into asset division, including:

  • Hidden assets, as we engage forensic accountants to locate all assets, including offshore accounts
  • Complicated financial assets such as stocks, securities and cryptocurrency
  • Business ownership, valuation and division
  • Real estate, including second or third homes, vacation property and rental or commercial real estate

While there are many attorneys who handle divorce, not many have the financial background as the attorneys on our team. When you work with us, you get dedicated personal service that is grounded in solid strategy.

CHILD CUSTODY, VISITATION AND PARENTING TIME SCHEDULING

We can help you create a plan that meets your child’s needs. In most cases, there will be joint legal and physical custody, with both parents having similar parenting time. Parenting time is most often “shared.” This means it is very rarely an exact 50-50 split. Typically, due to a child’s school and extracurricular activity, the arrangement will be closer to a 60-40 or even a 70-30 split of time. Parents going into negotiations who understand this typically fare better and have less contention.

We also represent parents, grandparents, guardians and others caught up in allegations of child abuse or neglect, investigated by the Division of Child Protection and Permanency Service (DCP&P). Those under investigation should not make any statements without legal representation. Do not sign any documents until your attorney is present. Many DCP&P cases conclude within merely 60 days, so it is of utmost importance that you seek a lawyer as soon as you possibly can.

CHILD SUPPORT

There is nothing more important than meeting the material and educational needs of the child. This includes ensuring that the child lives in a safe place, receives regular health and wellness attention and is afforded financial access to the activities that foster growth and development. We know that even with set guidelines in place, this process to pay or receive child support can be murky. We are here to guide you through the steps to ensure that your child receives the child support needed to maintain their lifestyle and well-being.

SPOUSAL SUPPORT

Also called alimony or spousal maintenance. Our extensive financial background provides us with a keen understanding of how support is determined and the factors that influence who gets support, how much and for how long. We have extensive knowledge and experience with marriages that involve a history of violence.

DOMESTIC VIOLENCE

Domestic violence is serious and pervasive. Our team understands how to effectively deal with an abuser to end the contact and the abuse. We can provide guidance, support and representation for you if you have suffered or are in fear of imminent domestic violence. Most often, the best first step is to obtain a temporary restraining order (TRO).

PRENUPTIAL AND POSTNUPTIAL AGREEMENTS

There is a reason that prenups are becoming more and more common today. A prenup, or any agreement that happens after the marriage has occurred (postnuptial), gives both people a clearer understanding of the needs and expectations they each have. As almost half of today’s marriages do end in divorce, it is not unwise to hope for the best and prepare for the worst. Prenups have actually been shown to reduce the stress in a marriage, since both people know what will happen if things don’t work out.

KNOWLEDGEABLE AND COMPASSIONATE ADVOCATES

You most likely have many questions about the divorce process, including how much it will cost and how long it will take. When you want it most, knowledgeable and compassionate guidance to experience a successful and less stressful divorce is available. Our divorce and family law services are also available to our Spanish-speaking clients.
